Submission of Request and Grant of Consent

In connection with the submission of the application for receiving my credit information offered by TransUnion CIBIL Limited (TU CIBIL) (“Product”) through submission of request to ICICI Bank Limited (“Agent”) and the delivery of the Product to the Agent, I hereby acknowledge and agree to the following:

 

  • The Agent is my lawfully appointed agent and it has agreed to be my agent for the purposes, including, without limitation, to receive the Product from TU CIBIL on my behalf and use it in the manner consistent with the end-use policy of my Agent (“Agent’s End Use Policy”) or the understanding between me and my Agent (“Terms of Understanding”), as the case may be and the Agent has granted its consent for being appointed for the aforesaid purpose.

  • I grant my unconditional consent to the Agent to receive the Product from TU CIBIL on my behalf and use it in the manner consistent with the Agent’s End Use Policy or the Terms of Understanding, as the case may be, and the Agent has granted its consent for being appointed for the aforesaid purpose. I hereby represent and acknowledge that: (a) I have carefully read the terms and conditions of the Agent’s End Use Policy and understood the same; or (b) the Terms of Understanding in relation to the use of the Product has been agreed between me and my Agent.

  • I hereby expressly grant unconditional consent to and direct TU CIBIL to deliver the Product to the Agent on my behalf.

  • I shall not hold TU CIBIL responsible or liable for any loss, claim, liability or damage of any kind resulting from, arising out of or in any way related to: (a) delivery of the Product to the Agent; (b) any use, modification or disclosure by the Agent of the contents, in whole or in part, of the Product, whether authorised or not; (c) any breach of confidentiality or privacy in relation to the delivery of the Product to the Agent; (d) for any use made by the Agent which is contrary to the Agent’s End Use Policy or Terms of Understanding or otherwise.

  • I acknowledge and accept that: (a) TU CIBIL has not made any promises or representations to me in order to induce me to provide the Product Request or seek any consent or authorisation in this regard; and (b) the implementation of the Agent’s End Use Policy or Terms of Understanding is solely the responsibility of the Agent.

  • I agree that I may be required to record my consent / provide instructions electronically and in all such cases I understand that by clicking on the ‘I Accept’ button, I am providing "written instructions" to the Agent authorising the Agent to obtain my Consumer Credit Information from my personal credit profile from TransUnion CIBIL Limited, (formerly known as Credit Information Bureau (India) Limited). I further authorise the Agent to obtain such information solely to confirm my identity and deliver the Product to me. Further, in all such cases, by checking this box and clicking on the ‘Authorise’ button, I agree to the terms and conditions, acknowledge receipt of TU CIBIL privacy policy and agree to its terms and confirm my authorisation for the Agent to obtain my Consumer Credit Information.

  • I understand that in order to deliver the Product to me, I hereby authorise the Agent to obtain my Consumer Credit Information from TU CIBIL.

    By submitting this registration form, I understand that I am providing express written instructions for the Agent to request and receive information about me from third parties, including but not limited to a copy of my consumer credit report and score from consumer reporting agencies, at any time for so long as I have an active account with the Agent. I further authorise the Agent to retain a copy of my information for use in accordance with the Agent’s Terms of Use and Privacy Policy.

  • I understand that the Product is provided on an “as-is”, “as available” basis and TU CIBIL expressly disclaims all warranties, including the warranties of merchantability, fitness for a particular purpose and non-infringement.

  • I shall not sue or otherwise make or present any demand or claim and I irrevocably, unconditionally and entirely release, waive and forever discharge TU CIBIL, its officers, directors, employees, agents, licensees, affiliates and successors , jointly and individually (hereinafter “Releasee”), from any and all manner of liabilities, claims, demands, losses, claims, suits, costs and expenses (including court costs and reasonable attorney fees) (“Losses”), whatsoever, in law or equity, whether known or unknown, which I ever had, now have or in the future may have against the Releasee with respect to the submission of the Product Request and / or my decision to provide TU CIBIL with the authority to deliver the Product to the Agent. I agree to defend, indemnify and hold harmless the Releasee from and against any and all Losses resulting from claims made against TU CIBIL by third parties arising from and in connection with this letter.

  • I agree that the terms of this confirmation letter shall be governed by the laws of India and shall be subject to the exclusive jurisdiction of the courts located in Mumbai in regard to any dispute arising hereof. TU CIBIL is entitled to assign its rights hereunder to any third person without taking my prior written consent.

FAQs about CIBIL

Is CIBIL a list of defaulters?

No. CIBIL maintains account information of various loan customers and credit card customers, whether they are defaulters or not. The information comprises their name, address, monthly repayment track record, outstanding amounts, etc.

Are all customers' names reported to CIBIL?

Only borrowal accounts, i.e. those customers who have availed of a loan or a credit card from a CIBIL member are reported to CIBIL. Details of liability accounts such as savings, fixed deposits and recurring deposits are not shared with CIBIL.

On what segments does CIBIL provide a credit report?

CIBIL is a repository of credit information and in the consumer segment it provides information on the various loans availed of and cards held by an individual from a member bank. Its commercial report covers the credit availed of by non-individuals.

What is the content of a CIBIL report?

CIBIL only reports loan and credit-card information such as repayment track, loan type, amount outstanding, loan amount disbursed, various dates, etc. The report also contains a customer's personal information like name, address, date of birth, phone number(s), passport number, voter's ID number, PAN, etc. In a commercial credit report the inputs are similar but include some additional details pertaining to the commercial entity like legal constitution, registration number, etc. The credit report does not provide any opinion or comment on whether a loan should be extended to a customer. It reports the facts that its member banks and financial institutions have reported.

How is a credit report helpful to credit underwriters?

The credit report shows account information such as repayment record, defaults, type of loan, amount of loan, etc. of the customer. This information facilitates prudent decision-making when the credit underwriter processes the loan/credit-card application.

How can a customer maintain a good credit history?

A customer will be able to build a good credit history by proper financial planning and by maintaining a good track record of repayment of dues for loans / credit cards.

Who contributes credit information to CIBIL?

The information is contributed by banks and financial institutions that are members of CIBIL.

Can a customer's name be removed from CIBIL's database?

Member banks contribute to CIBIL on a monthly basis data of all their customers who maintain a loan/credit-card account with them. Hence a customer's name cannot be removed from CIBIL's database.

If a loan/credit-card application is rejected, will it be reflected in the credit report?

A credit report reflects only credit information reported by member banks. Hence, details of loan applications are not available in the credit report. However, information about the number of times a CIBIL report has been generated can be obtained from the “Enquiries” section in the CIBIL Report.

If a loan is denied to a customer by one bank on the grounds of the CIBIL report, will it be denied by other banks too?

Approval or rejection of a credit application depends on the bank's policies. Rejection by one bank on the grounds of the CIBIL report might not imply rejection by another bank.

Can ICICI Bank share its customers' account-information with CIBIL?

According to the loan agreement with ICICI Bank signed by the borrowing customer, the Bank can indeed share the data with CIBIL.

If a customer's family member has defaulted, will it affect the customer's status in CIBIL's records?

The CIBIL report has information of loan/credit details of the borrower only. Therefore, for a retail customer, it would not matter if someone in his/her family has defaulted. If the customer's repayment track record is okay, his/her credit score will not be affected by that of his/her family members.

How many days does it take to update a customer's payment status?

Customers' account information is sent to CIBIL month on month for update into CIBIL's database. It takes generally 45-60 days from the month-end to update the record in CIBIL's database.

Can a customer's repayment track be overwritten in Credit Bureaus data base?

Member banks report data to credit bureaus on a regular basis, thus in case of a delinquent customer, if a customer has cleared all of his/her over dues in the current month the repayment track in his/her credit report will be updated from current month onwards. Please note that the records for the previous period will, however, continue to reflect the past behaviour.
